Due to the publication of Notification on NSD’s intention to maintain the register of contracts on the official FFMS of Russia website, NSD informs on the following:
- On February 6, 2013 NSD starts performing functions of the Repository and maintaining the register of contracts which are concluded on the basis of the Master Agreement (integrated agreement).
- At the same time the Special order of interaction, active since December 10, 2012 with the Clients, entered into Additional agreement to the Agreement on the terms and conditions for provision of repository services with NSD, is terminated.
- On March 6, 2013 amendments to the Terms and conditions for the provision of repository services (hereinafter – the Terms) come in effect.
The Terms contain specified types of contracts which shall be reported to the Repository’s register of contracts. In accordance with the amendments, dated February 6, 2013, currency swap contract is specified according with subparagraph 2 of the paragraph 6.1 of FFMS of Russia Order dated 28.12.2011 № 11-68/pz-n.
- Amendments are made to the Agreement on the terms and conditions for provision of repository services in both Russian and English languages (for natural persons and legal entities) (hereinafter – the Agreement). A paragraph, specifying termination of Agreement is amended.
Those Clients, who have entered into Agreement on the terms and conditions for provision of repository services until February 6, 2013, should contact NSD’s representatives and till July 1, 2013 enter into an Additional agreement to the Agreement on the terms and conditions for provision of repository services. The Additional agreement is disclosed on NSD’s website in Repository regulations, rules and legislation section.
Please note that in accordance with paragraph 2.2 of FFMS of Russia Order dated 28.12.2011 № 11-68/pz-n, persons, obliged to report information on contracts, concluded on the terms of the master agreement, shall provide Repository with information on all such contracts, concluded on the terms of the master agreements after August 11, 2011 and until entering into Agreement with the Repository, in case of obligations under such contracts are not fulfilled on the reporting date.
- Repository services are provided by NSD in accordance with the Terms and conditions for the provision of repository services. Entering into Agreement on the terms and conditions for provision of repository services with NSD set interaction framework between the Client and NSD and does not indicate the beginning of the term, specified in paragraph 2.2 of FFMS of Russia Order dated 28.12.2011 № 11-68/pz-n, in which Client’s reporting agent shall provide Repository with information on contracts. The term starts from the moment of entering into Repository services agreement for contracts, concluded under terms of the master agreement. The Client enters into Repository services agreement by submitting to the Repository Master Agreement reporting form which is registered in the Repository’s register of contracts. The Repository services agreement is concluded for each Client’s master agreement.
Agreement on the terms and conditions for provision of repository services and the Terms and conditions for the provision of repository services are disclosed on NSD’s website in the Repository regulations, rules and legislation section.
